The construction law attorneys of Schoech Law Group have recently filed a construction defect lawsuit in Northern California’s San Joaquin County against a local builder. The lawsuit was filed on behalf of a group of frustrated owners who purchased their single family residence in a new tract-home community. Several homes are suffering from severe water intrusion through the windows resulting in interior water damage. After a rush filing of the group action case in the county court, construction law attorney, Matthew Schoech, was able to protect the legal rights of his clients whose homes are approaching the ten-year statute of limitations.
California law contains a “statute of limitations” which puts a maximum time limit of 10 years in which a homeowner may bring a lawsuit against the builder/developer for construction defects. The time limit is contained in the California Code of Civil Procedure, section 337.15.
An amended complaint to the lawsuit is being filed this week adding new homes that are also near the ten-year statute of limitations.
